Family mediation is an out-of-court method for settling conflicts involving finances, children, or a mix of the two. It is a voluntary, private procedure in which a neutral, professionally qualified mediator assists a separated couple in exploring and, ideally, negotiating future arrangements. A mediated agreement is indeed not legally enforceable until the participants have had the opportunity to consult independent legal counsel. After this, both parties’ attorneys (if solicitors are retained) will convert the amendment grounds into an order that may be filed with the court for a judge’s approval.

A mediator fosters conversation and assists couples in identifying solutions that are beneficial for them and their children. As mediators, we are tasked with assisting the couple in evaluating their settlement proposals and indicating where the assistance of additional specialists might be beneficial to the conversation. This may include identifying where tax guidance may be required, where a pension specialist must be called to analyse the value and/or income of pension assets, or where financial planning is required so that the couple may envisage their financial futures in detail. In cases involving children, we usually recommend clients to child therapists or parenting experts.

Except for the revelation of financial information, clients and their attorneys cannot refer to discussions with the mediator in any court proceedings. This allows customers to accept or concede issues without fear of being held accountable if an overall settlement cannot be reached.

Prior to initiating court procedures, divorcing spouses are often expected to have explored mediation. Exceptions include situations requiring domestic violence, child safety, or urgent financial preservation concerns.
